Town Board Meeting
September 7, 2010
I. Meeting was called to order by Chair Roger Van Beek at 7:00 pm.
II. Roll Call: present was Chair, Roger Van Beek, Mary Murphy, Bill Gnatzig, John Humphrey, absent was Milo Oppegard. Also present was Treasurer, Brenda LaValley, who left at 7:30, Clerk, Lola Higgins and DZA, Ed Flanum.
III. Statement of Public notice was given and put on file for public record.
IV. Clerk’s report was given and put on file for public record. Minutes were corrected and approved RVB/MM all in favor.
V. Treasurer’s report was given and put on file for public record.
VI. Building Inspector’s report was reviewed and put on file for public record.
VII. Public Comments: none
VIII. New Business
a. Storm Disaster discussion and possible action. Roger Van Beek explained that the County was helping to fund damage done to a culvert on Rifle Range. Van Beek went on to explain to the Board that he recommends the town accept the quote by the County and move forward to schedule the repair for this fall. RVB/JH all in favor.
b. Poll workers for the September Election. There will be five poll workers at each shift for the September 14 election.
IX. Old Business
a. Rural Fire Association, discussion and action, 1, Review and approve updated Bylaws, 2, Approve Rural Fire Association Ordinance and Resolution, 3, Contract for Fire Protection Services between the City of River Falls and the Rural Fire Association, discussion and action on all three items. Mary Murphy recommended reading the new Bylaws but they will change with the new contract with the City so it would be a correct action to put the Bylaws on hold. She moved on to the ordinance the Rural Fire Association wanted the town to sign to be able to charge for Fire Protection services and a Resolution to Recover fees for Fire Department Response, and a Resolution to set amounts for recovery of Fire Department Response Fees. The Board reviewed both documents and a motion was made to accept Ordinance 2010-3, RVB/BG and a motion was passed to accept resolution 2010-3 RVB/JH all in favor. Both documents were signed and certified by the Clerk as to posting and effective date of passage and publication. Contract for Fire Protection between the City of River Falls and the Rural Fire Association. Mary Murphy explained that Bob Loberg reviewed the contract and he had many concerns with the contract. Both Mary and Bob thought the contract was not clear, and there were a number of points Mary explained to the Board that were open ended and made the contract not clear. She went on to explain that the formula for how much each town would pay is determined by the Population, Equalized Value and average of Fire Calls. The 2% Fire Dues which was used to purchase some of the equipment was discussed and how that would be handled since 2% money is earmarked from the State on how it is spent and how the profit from the sale of the equipment would be handled. If the City sold the equipment for a profit, Mary suggest the towns be reimbursed 90% of the profit. The City is also proposing that there be two representatives on the new Board and three from the City. Bob Loberg told Mary Murphy he had grave reservations regarding the contract and he would like to see a 5% cap put into the contract. After more discussion Murphy suggested getting a second opinion on the price of equipment and how to use the 2% money of the sale. She also stated it may be best to shorten the length of the contract to 1 year, and try to get the City to agree with equal partnership of the Board. Murphy went on to say she talked with the Town of Warren to see if they would be interested to do half of our fire protection. She wanted to get on the agenda at a Warren town board meeting and have the discussion with them. Roger Van Beek ended the discussion by saying it was important to go the Rural Fire Association meeting next Wednesday and table the discussion tonight.
b. Animal Control Ordinance. The Board reviewed an Ordinance given to us by Bob Loberg on an Animal Control Ordinance for Diamond Bluff, WI. The Boards comments were the Ordinance covers all aspects of animal control and even though all things are not needed very often, it would be convenient and specific to use an ordinance like this and have help from a humane officer in St. Croix County. Van Beek recommends Loberg to clean up the ordinance and make it fit our town as well as have the Humane Officer in St Croix County take a look at it, and bring it back to a Town Board meeting when the document is ready.
c. Building Code Ordinance, discussion and action. The Board reviewed Ordinance 2010-2 and made a motion to approve it, MM/BG all in favor.
d. Family Picnic, discussion and action. Last minute details were made to organize the picnic, and it was decided the Town Board would start at 11:00 am Sunday.
e. Bills were paid, RVB/MM all in favor
f. Chair Announcements: Budget meeting September 13, 6:30, Open Book, September 21, and BOR September 23 both 6 to 8 pm.
g. Adjourn RVB/MM all in favor.
