Town Board Meeting

May 4, 2010

  1. Meeting was called to order by Chair Roger Van Beek at 7:00 pm.
  2. Roll Call:  All Town Board members were present, Roger Van Beek, Mary Murphy, Milo Oppegard, Bill Gnatzig and John Humphrey.  Also present was Brenda LaValley, Treasurer, Lola Higgins, Clerk and Dave Simons Town Engineer.
  3. Statement of Public Notice was given and put on file for public record.
  4. Clerk’s report was given and put on file for public record.  Minutes from the April 5, 2010 meeting were approved, MO/RVB all in favor.
  5. Treasurer’s report was given and put on file for public record.
  6. Building Inspector’s report was not available at this time.
  7. Public Comments: Candace Bettendorf stated Elaine Ray’s culvert has been hit by the Road Trimmer and needs to be serviced. 
  8. New Business
  9. John and Cathy Moeger, fire bill for dog stuck in culvert, the Moegers’ feel the culvert was not properly maintained and would like the town to split the fire bill.  Discussion and action.  John Moeger presented and told the Board how he was picking up trash in the ditch, his dog was not on a leash, and it ran into the culvert.  The dog spent 36 hours in the culvert, the fire department was called and after they worked two hours Darrell Dunn Septic was called in to get the debris out of the culvert.  Mr. Moeger stated the culvert was about 80% blocked with debris.  The Moeger’s felt that if the culvert had been better maintained their dog would not have been stuck in the culvert.  They went on to say that because the dog was unleashed they felt responsible for half the bill and asked the town to consider the other half which is $450.   After a discussion a motion was passed to agree to split the fee charged ($450.00) to the Moeger’s for rescue of the dog in the culvert.  JH/MO all in favor.  The Board asked the question if this was setting a precedent and the discussion went on to state that there were many differences to this case as the Utility Company had just done some work there and the County came in to repair the disturbance, but the job was never done sufficiently.
  10. Recommendation from the Plan Commission to the Town Board on the Road and Driveway Ordinance, with the addition of Private Roads.  Discussion and action.  Mark Enter and Bob Watrud of Lakeside Foods, the Canning Company in New Richmond were present.  Mark Enter, general manager began, he stated that in previous years their company did not return the town roads to their original state after harvest.  He went on to say they may still visit these areas.  He also said that the ordinance was not the correct way to do business.  He felt the ordinance makes it difficult for him to do business in the town, he asked the Board to reconsider.  The Board discussed that the Comprehensive Plan encourages agriculture and farming and they should do what they can to encourage it.  Mark went on to ask the town to please call if there is a problem and he assured the Board that his company would be onsite in 24 hours to take care of the problem.  After a short discussion the Board decided to make a change to that part of the ordinance so the Canning Company will not be bonded to use the road, but a verbal agreement is in place, and this item will be re-visited as needed.  The discussion went on regarding the ordinance.  Mary Murphy asked why anyone would want a private road?  The pros and cons were discussed.  A few changes were made to the ordinance.  A question came up; if the town can have a private road longer than 1000 feet.  Research will be done and an answer will be at the next town board meeting.  At the June Town Board meeting there will be a Public Comment time for the Road and Driveway Ordinance.
  11. Discussion and action on town website, after a short discussion a motion was made to approve Town Web Design to re-design and set up the towns’ website per the proposal given to the town board.  BG/MM all if favor.
  12. Discussion and action on Kinni Family Day event as suggested at the Annual meeting.  Roger Van Beek and Bill Gnatzig offered their grilling expertise a date was set, September 12, 2010.  It was suggested resident volunteers would be welcome, someone suggested using the 4-H groups to do face painting and games. 
  13. Fences, review what the town has on the books for resolution and ordinances, discussion and action.  Roger Van Beek stated he would like Bob Loberg to get the town a clear written out procedure and have Bob come to a town board meeting and speak to residents, board members and surveyors on how to handle fence issues.
  14. Update Emergency Plan, The plan was updated by each board member signing the 2010 copy and a motion was made to approve the succession the same as previous years.  RVB/MO
  15. Building Inspector and Deputy Zoning Administrator, short list of candidates, discussion and action.  It was decided the short list would come before the Board with application and cost for services and insurance they carry.  The Board would like written and oral proposals.
  16. OLD BUSINESS
  17. Road Committee update.  Roger Van Beek explained the Road Review was done last month.  Dave Simons explained that the town has out bids for cut and patch areas.  It was also discussed that the Board would discuss next month a person to be hires to create an inventory of signs, culverts, ditch obstruction etc.
  18. Land Use Committee, Bernie Van Osdale has been added to the committee and at the next Land Use Committee meeting the membership will be updated and approved.  There will be a meeting May 13 and the sub division ordinance will be discussed.
  19. Rural Fire Association update.  May 19th is the next meeting.  The ordinance is still being looked at.
  20. PAY BILLS, RVB/JH all if favor.
  21. Chair Announcements, next Town Board meeting with Board of Review and Public Comments, plus other agenda items will be June 1.
