Town of Kinnickinnic

Town Board Meeting

July 6, 2010

        I.            Meeting called to order by Chair Roger Van Beek at 7:00 pm.

      II.            Roll Call: present was Chair, Roger Van Beek, Mary Murphy, Bill Gnatzig, John Humphrey, Milo Oppegard, Treasurer, Brenda LaValley, Clerk, Lola Higgins, Building Inspector, Brian Wert and DZA candidate, Ed Flanum.

    III.            Statement of Public Notice was given and put on file for public record.

    IV.            Clerk’s report was given and put on file for public record, minutes from the June 1, 2010 meeting were corrected and approved, BG/MO all in favor.

      V.            Treasurer’s report was given and put on file for public record.

    VI.            Building Inspector’s report was given and put on file for public record.

  VII.            Public Comments: Dave Nelson expressed how upset he was with the Town Board that he received a second letter regarding his fence dispute and he feels the letter was unwarranted.  The Clerk reminded the Board that this is not discussion time, but comment time, Roger Van Beek asked that the fence dispute of Dave Nelson’s be put on the agenda at next month’s meeting.

VIII.            New Business

a.       Form a Park Committee to work in cooperation with, St. Croix County, City of River Falls, Kinnickinnic River Land Trust and the DNR, discussion and action.  Roger Van Beek gave the Board a short background of the need for such a committee.  He explained the Plan Commission is working on the Comprehensive Plan, commercial and recreational areas; he went on to say that there needs to be a strategic long term plan.  It was discussed who should be on the committee, from residents with different backgrounds and abilities, to someone familiar with grant writing.  It was suggested the committee should look for opportunities that are out there and we are not aware of, the discussion went on to suggest development of parameters and expectations for the committee. Once the structure of the committee is in place it was suggested that the Board put an ad in the River Falls Journal and on the website seeking volunteers. The Board was in agreement that the authority of the committee would be the Town Board and the committee would make recommendations to the Board.  A motion was made to direct the Plan Commission to proceed to develop parameters and establish a Park Committee for Kinnickinnic.  BG/MO all in favor.

    IX.            OLD BUSINESS

a.       Brian Wert, fee schedule and contract, discussion and action.  Brian gave the Board members a real case with our current fee schedule applied and his fee schedule applied.  After the Board reviewed the applications, they are interested in using Brian Wert’s fee schedule.  A motion was made to accept the new fee schedule resolution for next month and sign a contract from Brian Wert.  RVB/BG all in favor.

b.      Ed Flanum, Independent contractor, hourly rate or retainer, fees and services, discussion and action.  Roger and Mary Murphy discussed if there would be a conflict of interest with Ed being a surveyor, but decided; Ed’s knowledge of zoning would be an asset to the position.  A motion was made to accept the contract for Ed Flanum as the Deputy Zoning Administrator.  RVB. /JH all in favor.  Roger Van Beek and Ed Flanum signed the contract, Clerk Higgins attested.  A second motion was made to review the existing zoning portion of our fee schedule resolution and make any adjustments necessary. RVB/BG all in favor.

c.       Review animal control ordinance from Bob Loberg.  This item was tabled until the end of the meeting.  At the end of the meeting the Board agreed to table this item until next month.

d.      Milo Oppegard, regarding bike signage, discussion and action.  It was discussed that the speed limit posts will not be used for bike signs as they are used for weight limit signs.  John Bettendorf and Dave Nelson both voiced their frustration and inconvenience with bike riders using the town roads or any road within the town.  Milo Oppegard reminded the town that bikes have the same right to the roads as cars. Roger Van Beek said he would be contacting the Sheriff’s Department and explain to them the possible problem of bikers not following road rules. Bill Gnatzig expressed his concern with safety on the town roads and added that the plan was made with safety in mind, he went on to say it is a reasonably safe suggested pathway to get from the City through the township, and the money spent on the signs would be from the Park Fund and would not be resident tax money.  A motion was made to accept the price quote for the Bike signs for $1,787.39 JH/MM all in favor.  It was discussed that Milo Oppegard would contact the County regarding the installation of these signs and Roger Van Beek would contact the County for extra patrols for Kinnickinnic roads.

e.      Road Committee update.  Tree Trimming bids were discussed, (on file for public record) The Road Committee recommends to the Town Board to use St. Croix Tree Service as their bid was the lowest.   A motion was made to accept the Road Committee recommendation to award the tree trimming bid to St. Croix Tree Service for $10,075.00 BG/RVB all in favor.  A second motion was made to accept JCE Tree Service and their price quote for emergency and non-emergency services contingent on they will do the work at quoted prices knowing they won’t be doing the bided work.   BG/JH all in favor.  Seal coating and striping of the town hall parking lot was the next item of discussion, Roger Van Beek stepped down and Bill Gnatzig took over the Chair position.  The Road Committee took bids for this item and after a short discussion a motion was made to award seal coating and striping bid to Asphalt Associates for $2,150.00 BG/MM all in favor.  Roger Van Beek abstained.  Bill Gnatzig turned the chair over to Roger Van Beek.  Roger told the Board that the County gave their opinion on the Road and Driveway Ordinance and there are issues that need to iron out before adoption.  The issues involve the private road portion and if the town can regulate private roads and should we allow private roads. If adopted as is, our ordinance would be in conflict of the County.  More work will be done to try and work out the details.

f.        Land Use Committee update.  Roger Van Beek stated they are in the early stages to start talks with the City on Boundary Agreement.

g.       Fire Association update.  Mary Murphy expressed her frustration of the City’s proposal for a contract with the Rural Fire Association.  Murphy explained the two options the City gave the Rural and both were unacceptable to Murphy.  She explained that the Rural needs professional help because the issue is so complex and she is in her estimation not qualified to make the decisions that need to be made. She also feels that the City is not providing the Rural with the numbers they need to make these kinds of decisions.  Her suggestion is to have half of the town use Warren for fire protection; to save money as the proposal from the City if more than doubled from last year.  Murphy asked to be excused from the position of Rural Fire Association liaison as she feels she is not effective in this position. It was suggested Bill Gnatzig take over.   Bill Gnatzig said he would like to review this appointment and see if it would fit his schedule and asked Mary to stay with the position for the next month.  A motion was passed, for the Town Board to recommend to the Rural Fire Association to get outside professional consultant to help negotiate the contract with the City.  RVB/BG all in favor.

      X.            Pay Bills, it was discussed that money would be taken out of the Capital Equipment Fund to cover the extra money paid to the Assessor for the re-evaluation this summer.  Motion was made to pay the bills.  RVB/JH all in favor.

    XI.            Chair Announcements: LUC meeting 7/7/10, 4 to 8.  Put the Kinni Picnic on next month’s agenda.

  XII.            Adjourn, RVB/.MO all in favor.
